Protection of your personal Data

We, are happy about your interest in Bluecode Africa and we want to secure, that you feel safe during the use of the Bluecode Africa App. We take the protection of your personal Data really serious.

Below we want to explain to you in detail, how the personal data from you during the registration from the Bluecode Africa App will be collected and disseminated.

What is personal data?

  • Personal data is all data that contains information about personal or factual circumstances of a specific or identifiable natural person. For the purposes of this Privacy Policy, personal data refers to all information that has been provided by a User whilst installing the App.
  • ‘Special categories of personal data’ include personal data pertaining to racial, ethnic, genetic or biometric data amongst other. Please note that the Company does not collect or process special categories of personal data.

 

Information We collect and/or process

  • The Company applies the ‘zero knowledge’ principle, that is, We ensure that We do not collect or process any bank account details. Please note that except from the personal data mentioned below, your personal data never enters the Company’s records or filing system neither manually nor by automated means.
  • The following personal data are collected strictly for the instalment, use and the good running of the App:
  • Device ID or unique identifier; and
  • Device Type.
  • The following personal data may be collected to report to the User, the details of its Bluecode transactions, if and when requested by the User:
  • Email address; and
  • Location data of your business location(s) is shared by the User in order to be able to send you the reports for one or all of your business location(s).
  • The Company will only process your personal data where:
  • We have your documented instructions (if consent is needed);
  • We need to use the information to comply with our legal and regulatory obligations;
  • We need to use the information to provide you the service through the App; and
  • the processing is necessary for the functions to be performed through the App.

 

Disclosure of the User’s personal data

  • We may share your personal data with relevant third parties where:
  • You have given us your express consent to do so;
  • It is necessary to allow us to meet or enforce a legal obligation; or
  • Disclosure is required by law enforcement agencies in line with any applicable law regulations, official request or court order.
  • Please note that We do not disclose personal data to third parties for advertising or any other purposes not consistent with the purpose for which your personal data was collected.

 

Your right over your personal data

  • You have the right to:
  • request for access to the personal data We collect by making a written request to the Company, and We shall provide You, at reasonable interval, without excessive delay the confirmation as to whether or not your personal data is being processed and forward you a copy of the data;
  • request for a rectification of your personal data on the ground of inaccuracy;
  • request for the erasure of your personal data if:
  • You withdraw your consent and there is no other legal ground for the processing; or
  • You object to the processing of your personal data and there are no overriding legitimate grounds for processing or restriction of processing of your personal data or to object to the processing of the data;
  • lodge a complaint in relation to the processing of your personal data or any breach, with the Data Protection Office of the Republic of Mauritius

 

Data Protection Officer

  • One of the Company’s duties is to designate a Data Protection Officer who will be responsible to monitor the internal compliance with Nigerian data protection laws and regulations.

Transfer of personal data outside Nigeria.

  • Please note that the Company may transfer your personal data to countries or territories where the transfer is necessary:
  • for the performance of a contract between You and the Company or the implementation of pre-contractual measures taken at your request;
  • for the conclusion or performance of a contract concluded in your interest between the Company and another person;
  • for reasons of public interest as provided by law;
  • for the establishment, exercise or defence of a legal claim;
  • in order to protect the vital interests of the data subject or of other persons, where the data subject is physically or legally incapable of giving consent; or
  • for the purpose of compelling legitimate interests pursued by us which are not overridden by your interests, rights and freedoms involved and where:
  • the transfer is not repetitive and concerns a limited number of Users; and
  • the controller or processor has assessed all the circumstances surrounding the data transfer operation and has, based on such assessment, provided to the Commissioner proof of appropriate safeguards with respect to the protection of the personal data.
  • For any transfer of personal data abroad, we always take appropriate legal, technical and organizational measures to ensure that your data is treated securely and that an appropriate level of protection is respected when transmitting your data to selected third parties. In the absence of appropriate safeguards, the User’s explicit consent will be requested.

 

How We secure your personal data

  • We have taken technical and organizational security measures to protect your personal data from loss, destruction, manipulation and unauthorized access. All our employees are obliged to comply with the prevailing data protection regulations and laws in Nigeria and deal with personal data confidentially.
  • In the case of the collection and processing of personal data, the information is transmitted in an encrypted form in order to prevent misuse of the data. The App is protected by Face ID, Fingerprint or Security PIN.
  • In the event of a personal data breach involving your personal data, the Company has a duty to notify the breach to the Nigerian Information Technology Development Agency and we shall take all necessary remedial action as well as measures to mitigate the possible adverse effects of the breach. Moreover, where the personal data breach is likely to result in a high risk to your rights and freedoms, We are bound to inform you about the personal data breach

 

Legal Basis

  • By downloading the App and by accepting this Privacy Policy, you consent for the collection and/or processing of your personal data which is necessary for the performance and proper functioning of the App on your mobile.
  • Please note that your personal data will be destroyed or deleted when:
  • You uninstall the App;
  • You send an Application Programming Interface request; or
  • Upon the written instructions of the bank.

 

Governing Law and Jurisdiction

  • The Company is incorporated in the Republic of Mauritius. General data protection regulations will be applicable only to the collection and processing of data through the instalment of the App.
  • The jurisdiction of the courts of the Republic of Mauritius will be applicable over any claim, dispute or matter arising with the enforceability of this Privacy Policy and personal data collected by the Company.
  • The App is also used by merchants and other partners which collect the Users’ personal data including for processing payment transactions. However, the Company is not responsible for the collection or processing of any other personal data other than the personal data stipulated at paragraph 3 above. Therefore, once the App is installed by the User, any data which is collected and/or processed by merchants and other partners for the functioning of the App will be governed by the data protection laws of the country in which you are transacting via the App. We urge you to refer to each merchants/banks respective privacy policies for more information.
